This document is officially referred to as Gorilla Marketing Pro Terms and Conditions. From this point on, 10X World, LLC will be known as Gorilla Marketing Pro. It includes Gorilla Marketing Pro Policies and Procedures and also includes or makes reference to other Policies enforced by Gorilla Marketing Pro.
Standards All Members Must Follow
A Member of Gorilla Marketing Pro agrees to always act honestly and fairly in a way that will enhance the reputation of the Member and Gorilla Marketing Pro when representing Gorilla Marketing Pro.
A Member must always offer full support as a sponsor of their personally referred Associates and future prospective Associates. This includes avoiding deceptive or illegal practices and making untrue claims regarding Gorilla Marketing Pro's services and administrative officers.
A Member agrees to not make public projections and claims regarding the income potential of any Member, including themselves and a Member understands that the success of other members may differ substantially and is determined by many variables uncontrollable by Gorilla Marketing Pro.
When promoting Gorilla Marketing Pro a member agrees to be respectful of all prospective Members. This includes respectful acceptance of all prospective Member comments and questions as well as their privacy needs.
A Member agrees to be and understands that they are solely responsible for any and all legal and financial obligations that could result from their Gorilla Marketing Pro Membership. This includes but is not limited to self-employment taxes, income taxes, sales/use taxes, etc.
A Member understands that the contents of this document may change occasionally at the discretion of Gorilla Marketing Pro, and therefore the Member agrees to review it often.
A member understands that if they have questions pertaining to any of the legal documents supporting Gorilla Marketing Pro they should contact the Support Team of Gorilla Marketing Pro for the most up-to-date answers to resolve those questions.
Membership Details
A Member of Gorilla Marketing Pro is required to understand and abide by the rules, terms, and policies outlined by Gorilla Marketing Pro.
Gorilla Marketing Pro reserves the right to change their rules, terms, policies, and website content at any time as they deem appropriate.
Gorilla Marketing Pro requires every Member to comply with all federal, state, provincial, and local laws, as well as all statutes and regulations governing Internet Marketing.
Member Status
An individual may become a Member by agreeing to comply with all Gorilla Marketing Pro Policies and Terms and Conditions. An applicant wishing to become a Member must fill out the registration form online and pay the required fees.
Gorilla Marketing Pro reserves the right to reject any person wanting to become a Member or withdraw the active status of a Member for any reason. Withdrawal of a Member's active status by Gorilla Marketing Pro after any fees have been collected may be refundable at Gorilla Marketing Pros discretion, and depending on the reason for termination of the Member's account.
Any personal information collected on the Gorilla Marketing Pro registration form will be retained in accordance with the Gorilla Marketing Pro Privacy Policy.
Member Status Rules
All Members are independent contractors of Gorilla Marketing Pro. Membership accounts with Gorilla Marketing Pro are not franchises, joint ventures, or partnerships with Gorilla Marketing Pro, nor does any Member count as an employee, agent, or administrator for Gorilla Marketing Pro. Members are strictly prohibited from stating or implying that they hold or maintain any other type of relationship with Gorilla Marketing Pro.
Members, both active and inactive have no authority to bind Gorilla Marketing Pro to any obligation.
A Member can become terminated at Gorilla Marketing Pro for violations of the Terms and Conditions or any other Policies. A Member whose status becomes Terminated immediately loses all access and rights to Gorilla Marketing Pro, their list of members and prospects in the system, and any leads.
Any prospects or members associated with a permanently closed account do not become the property of another member.
Member Fee Requirements
All persons over the age of 18, in countries approved to do business with according to the USA Government, can join with full access status by paying the current membership fee.
Member Rights
All active Members are authorized to promote and sell Gorilla Marketing Pro service to anyone that we are approved to do business with (see above).
Members must be of legal age, or age of the majority (whichever maintains precedence) in the state, province, or country of their primary residence. Gorilla Marketing Pro maintains the right to ask any Member to provide proof of age for any reason.
Member Identification
Members may be required at any time to provide Gorilla Marketing Pro with a valid government-issued tax identification number (or other means of identification as mandated by the Members home domicile tax authority), as well as a current and valid billing and mailing address, phone number and e-mail address.
This personal information will be used for purposes pertaining to a Members Gorilla Marketing Pro account only and will be kept in a secure location by Gorilla Marketing Pro.
Failure to provide such requested information and proof that it is current may result in the termination of the Members Gorilla Marketing Pro Membership.
Any penalties or fines that may result from issuing an incorrect tax identification number or other personal information to Gorilla Marketing Pro will be the sole responsibility of the Member.
Member Advertising and Account Rules
No Member has exclusive marketing and sponsorship rights over a specific territory. Members found to be implying such rights risk immediate termination from Gorilla Marketing Pro. No Member has been given the authority to supply other Members with exclusive marketing material, methods, leads, etc.
Members found to be implying such rights, either online or offline, risk immediate termination from Gorilla Marketing Pro.
No Member has the right to promote and collect funds from the sale of Gorilla Marketing Pro Products, services, or memberships from any personal website. The only websites where the sale of Gorilla Marketing Pro can occur are those provided by Gorilla Marketing Pro using the Gorilla Marketing Pros merchant account to collect funds from the sale.
Members found collecting funds for the sale of Gorilla Marketing Pro products, memberships or services risk immediate termination and could face legal action.
Member Legal Compliance and Taxation
It is the Member's responsibility to stay informed and comply with all international, federal, state and/or provincial statutes, laws, and regulations, and all local ordinances and rules concerning all aspects of their Gorilla Marketing Pro membership. Members are responsible for their own managerial decisions and expenditures, including taxes. Since no Member is a Gorilla Marketing Pro employee, with respect to any law, statute, or rule for federal or state tax purposes Gorilla Marketing Pro is not responsible for payment or co-payment of any employee benefits and/or taxes.
Members will not be treated as franchisees, joint venturers, partners, employees, or agents with respect to the United States Internal Revenue Code, Social Security Act, any federal, state and/or provincial unemployment act(s), or any federal, state, provincial or local laws, statutes, ordinances, rules or regulations. All Associate Members are considered to be Independent Contractors, with status dictating a non-employee status in all foreign locations.
Confidential Information
All information found in the Members Only Site is considered proprietary and confidential and for access by Members only. Information pertaining to other Members of the Gorilla Marketing Pro must not be shared with non Gorilla Marketing Pro Members or any third party.
Restricted Countries
Due to legal and tax considerations, Gorilla Marketing Pro may be forced to exclude residents of certain countries from becoming an active Member of Gorilla Marketing Pro.
Any Member found to be recruiting, targeting advertisements to, training residents of, or doing any other activity related to promoting their Gorilla Marketing Pro website in restricted countries risks immediate termination.
Gorilla Marketing Pro Web Site Materials and Content
The name Gorilla Marketing Pro, all copyrighted material, Intellectual Property, Gorilla Marketing Pro logos, and the names of all Company Products and services are the intellectual property of and owned by Gorilla Marketing Pro. Only Gorilla Marketing Pro is authorized to produce and market Products, materials, and literature under these intellectual property rights.
Use of Gorilla Marketing Pro name in any manner not approved or authorized by Gorilla Marketing Pro is prohibited.
Communications and Advertising
In all written promotional and information content both online and offline pertaining to Gorilla Marketing Pro, Members are permitted to use Gorilla Marketing Pro name as long as they have received company approval.
Any Member found to be transmitting, displaying, or sharing any form of self-constructed marketing material pertaining to Gorilla Marketing Pro including online and offline written material, endorsements, conducting live interviews, giving speeches, trade shows, etc. without written consent from Gorilla Marketing Pro will risk immediate termination.
Telephone Solicitation
Members are prohibited from using Gorilla Marketing Pro name or copyrighted materials with automatic calling devices, call centers, and all other broadcast means to solicit new business.
E-mail Solicitations
Gorilla Marketing Pro does not condone or tolerate the use of Unsolicited Commercial E-mail (UCE), Unsolicited Bulk E-mail (UBE), or Spam. All e-mails sent out by a Member to promote their Gorilla Marketing Pro business must fully comply with Gorilla Marketing Pro's strict Spam Policy.
Failure to comply will result in immediate termination of the guilty Member's Gorilla Marketing Pro account with no further access to the Members Only Site.
From time to time you agree that 10X World, LLC and Gorilla Marketing Pro may email your members tools or services that will help them promote their landing pages or get traffic. These would be limited to, at most, 2 times per month. There are no commissions paid to members for these sales. Any money made by 10X World, LLC and Gorilla Marketing Pro is to help us offset our costs to keep your membership free.
Price Changes
Gorilla Marketing Pro reserves the right to start charging a fee for its services at any time.
Membership Renewal
All Members who want to maintain an Active status with the ability to use the Gorilla Marketing Pro system, and have their own Gorilla Marketing Pro sales website and automated marketing system must stay in good standing with our TOS Policies.
Amendments and Modifications
Gorilla Marketing Pro reserves the right to amend any Gorilla Marketing Pro governing documents, Policies, Procedures, Terms and Conditions, company websites, etc. at any time, as the Company in its sole discretion deems appropriate.
Changes are considered effective and binding on all Members as of the date of them being presented live on the Gorilla Marketing Pro website. Members who continue to participate in any Gorilla Marketing Pro program, after such amended policies have been published and/or after being notified by Gorilla Marketing Pro or otherwise becoming aware of such amendments, shall be deemed to have accepted and agreed to any such amended policies, terms and requirements.
Non-Waiver Provision
No failure, delay or omission of Gorilla Marketing Pro to exercise any right, power, or provision contained within Gorilla Marketing Pro Policies and Procedures shall constitute a waiver of Gorilla Marketing Pros' right to demand exact compliance with all terms and provisions contained within Gorilla Marketing Pro Terms and Conditions on future defaults by any member.
Indemnity Agreement
In consideration for receiving Gorilla Marketing Pro Products and/or for participating in any Gorilla Marketing Pro programs, each Member agrees to indemnify and hold harmless Gorilla Marketing Pro, its shareholders, general/limited partners, successors, employees, agents, attorneys, officers and directors in any corporate or other business capacity from and against any demands, liabilities, losses, downtime, loss of data, costs, penalties, obligations, interest, damages and expenses of whatever nature or kind, including without limitation attorneys fees (including both outside and in-house counsel), and all other expenses, related to or arising from participation in any Gorilla Marketing Pro program.
This indemnity specifically extends to include without limitation any actions, results, causes of action, or allegations in connection with (i) any Associate Member's business and the activities of its affiliates as a Gorilla Marketing Pro Associate Member; (ii) any breach of any terms, policies and conditions agreed to by the Associate Member and/or contained in any Gorilla Marketing Pro Policies and Procedures, or; (iii) violation of any federal, state, provincial and/or local law, statute, ordinance, rule or regulation.
Entire Agreement
All Gorilla Marketing Pro Terms and Conditions and Policies, as well as all other Gorilla Marketing Pro governing documents, are hereby incorporated into a Member's Membership with Gorilla Marketing Pro. These together constitute the entire agreement of Gorilla Marketing Pro and any Member regarding their business relationship, and supersedes and cancels all prior and contemporaneous agreements, claims, representations, and understandings, oral and/or written, by or of the parties in connection with the subject matter hereof.
Severability
If, under any applicable and binding law or rule of any applicable jurisdiction, any provision of these Terms and Conditions and Policies, or any specific standard or operating procedure which Gorilla Marketing Pro has prescribed, is held to be invalid or unenforceable, Gorilla Marketing Pro shall have the right to modify the invalid or unenforceable provision, specification, standard or operating procedure or any portion thereof to the extent required to be valid and enforceable. The parties shall be bound by any such modification, and the modification will be effective only in the jurisdiction(s) in which it is required. Notwithstanding any such modification, if any provision of Gorilla Marketing Pro Terms and Conditions shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the remainder of Gorilla Marketing Pro Terms and Conditions and Policies, and shall not affect the validity and enforceability of any remaining provisions, nor shall it affect any other standard and operating procedures which Gorilla Marketing Pro has prescribed.
Gorilla Marketing Pro Liability
To the extent permitted by law, Gorilla Marketing Pro shall not be liable for, and all Members release Gorilla Marketing Pro from and waive all claims concerning, any loss of profits, any special or consequential damages, or any other losses incurred or suffered by any Associate Member and/or Subscriber as a result of: (a) the breach by the Associate Member and/or Subscriber of the terms and conditions specified in any Gorilla Marketing Pro Terms and Conditions or Policies and/or (b) the failure by an Associate Member to provide any information or data required by Gorilla Marketing Pro to operate its business and/or to conform to applicable laws; and/or (c) any incorrect or falsified information provided, intentionally or not, by any Associate Member, or by any agent or authorized representative of any such Member.
No Agency or Third-Party Beneficiary
Gorilla Marketing Pro is not the agent, fiduciary, trustee, or other such representative of any Member. Nothing expressed or mentioned in or implied from these Terms and Conditions is intended or shall be construed to give to any person other than the parties hereto any legal or equitable right, remedy, or claim under or in respect to this Agreement. This Agreement and all of the representations, warranties, covenants, conditions, and provisions of these Gorilla Marketing Pro Terms and Conditions are intended to be and are for the sole and exclusive benefit of Gorilla Marketing Pro and the agreeing Member.
Jurisdiction and Applicable Laws
The exclusive jurisdiction for any claim, controversy, lawsuit, or resolution of any matter relating to or arising under any Gorilla Marketing Pro Terms and Conditions or Policies shall be North Carolina, USA. The laws of the United States govern this Agreement and all of its terms and conditions, without regard to any conflict of laws and principles.
Arbitration
Except as noted herein, any dispute, controversy and/or claim arising out of or relating to Gorilla Marketing Pro, Gorilla Marketing Pro Products and Services, and/or any rights and obligations of a Member, or any other claims or causes of action relating to the performance under these Agreements by either Gorilla Marketing Pro or any Member and/or a Member's purchase of Gorilla Marketing Pro Products shall be submitted exclusively before binding arbitration, with hearings to be held in North Carolina, USA, or such other location as Gorilla Marketing Pro may designate in its sole discretion.
Each party to the arbitration shall be responsible for its own costs and expenses of arbitration, including legal and filing fees. The decision of the arbitrator shall be final and binding on the parties and may be reduced to judgment in any court of competent jurisdiction. This agreement to arbitration shall survive any termination or expiration of the Member Agreement. Notwithstanding the foregoing, the arbitrator shall have no jurisdiction over disputes relating to the ownership, validity, or registration of any mark or other intellectual property, or any confidential or proprietary information belonging to or held by Gorilla Marketing Pro, without Gorilla Marketing Pro's prior written consent.
Gorilla Marketing Pro may seek any applicable remedy in any appropriate forum with respect to disputes and any money owed to Gorilla Marketing Pro. In addition to monetary damages, Gorilla Marketing Pro may obtain injunctive relief in any appropriate jurisdiction against any individual for any violation(s) of Gorilla Marketing Pro Terms and Conditions and violation or misuse of them and all governing documents of Gorilla Marketing Pro.
Income Disclaimer
Gorilla Marketing Pro, nor its owners, partners, employees or board members make no claim that you will in fact make any money from Gorilla Marketing Pro to build any business.
Any claims made as to money made by other members or claims of building large teams or recruiting new members are just for demonstration purposes only and do not infer that any member has ever made money or recruited anyone.
SPAM consists of the following:
The sending of unsolicited email - meaning that the recipient of your email hasn't specifically requested the information you are sending, and/or the recipient of your email hasn't specifically agreed to receive your email.
Inappropriate postings in the USENET Newsgroups - meaning that your post has nothing to do with the topic of discussion for that particular newsgroup.
Enrolling an individual's personal information on your Gorilla Marketing Pro Landing Page causes the automated marketing system to send them emails.
If you are going to do legal email marketing, you are not allowed to include any URL that either directly points to any Gorilla Marketing Pro or your program web page or to a page that links to any Gorilla Marketing Pro Landing Page or your program web pages. You are also not allowed to mention the name Gorilla Marketing Pro or your program in your emails.
In addition, in order to be CanSpam compliant, all email messages must include the following items:
If your program or Gorilla Marketing Pro is forwarded a spam complaint that links to your Gorilla Marketing Pro website and the above criteria are not found in your email then you risk immediate termination.
Removal requests by the recipient must be dealt with immediately. Gorilla Marketing Pro does not allow you to send further emails to the recipient after the first Removal request is received by you. We suggest you save all removal requests for future reference in case you are accused of spam.
If Gorilla Marketing Pro is sent a copy of a removal request and we have proof that future emails were sent to the same recipient you risk immediate termination.
By agreeing to these terms you acknowledge you understand that if you violate our Spam policy your Gorilla Marketing Pro membership may be terminated immediately and you will forfeit all access to Gorilla Marketing Pro Members Only Site.
You also acknowledge that if your violation of this policy causes any damage or loss to our servers, or causes one (or more) of our websites to be interrupted from normal service, you will be held liable for damages and loss of business.
It is important to understand that every website, including your program and Gorilla Marketing Pro, exists on the Internet through the services of an Internet Service Provider (ISP). All ISPs are heavily regulated and take swift action when any of their clients are generating spam complaints.
If an ISP is not responsible in dealing with such clients they risk having their business shut down. As a result, ISPs are very strict with their clients.
As a result, Gorilla Marketing Pro must also enforce strict guidelines to reduce spam. Not doing so puts thousands of your program members' businesses in jeopardy of being taken offline by our ISP. So to protect you, your program business, and our business we require you to follow the Gorilla Marketing Pro Spam Policy closely.
Ignorance is no defense where SPAM is concerned - when in doubt, contact us first.

The Data Protection Officer (DPO) is the Privacy Officer and Head of Legal. The DPO is a senior staff in the management team. The responsibilities of the DPO are training and monitoring employees in accordance with the stipulations of the GDPR. The DPO oversees all activities pertaining to the Information Security program; which includes data privacy and security.

Since Gorilla Marketing Pro is a free service there is nothing to cancel. A member can however request via support ticket to have their account deleted at which time we will delete that member's account and all data associated with it. A member at any time can also ask to be removed from our mailing list however this will also include removing your account and all associated data from our system.
If you request your account to be deleted or to be removed from our mailing list, please allow up to 5 business days for it to be deleted.
Deleted members no longer have access to the Members Site and all personal prospects, members, and leads within the Gorilla Marketing Pro system will be permanently removed from the system.
Our Refund Policy applies to our Platinum PRO service. You don't need our Platinum Plus service to use GMP. You have everything you need to use GMP for FREE. The Platinum PRO service is explained inside the member's area.
There is a strict NO REFUND POLICY for the Platinum PRO service. Anyone requesting a refund will have their entire account deleted from GMP which includes but is not limited to any leads, landing pages, campaigns, commissions, bonuses, and more.
Anyone who completes a Chargeback with their credit card company to have any GMP fees reversed will have their account deleted from GMP. You will also be banned from ever joining any programs owned by or associated with but not limited to Gorilla Marketing Pro, 10X World, LLC, and Genusity, LLC. You will also be charged a fine of no more than $500 to cover the losses of but not limited to commissions paid out to you and/or your sponsor, chargeback fees associated with our merchants, and accountant fees. You will be sent a letter along with a bill from our Attorney and it must be paid within 30 days of receipt or it will be turned over for collections which may include Attorney fees, court costs, and reporting to the 3 major credit agencies. We take Chargebacks very seriously and there is never a need for you to do one. If you ever have a problem, talk to us first before doing anything else. You are supposed to be a professional so act like one. Remember, we are here to help you as much as we can and communication is the key to resolving any issue.
